These Terms of Service ("Terms") govern your use of the Pipsqueak website at pipsqueak.pet and all related services (the "Service") operated by Pipsqueak LLC ("Pipsqueak," "we," "us," or "our"). By using our Service, you agree to these Terms. If you do not agree, please do not use our Service.
Pipsqueak creates custom AI-illustrated sticker sheets featuring your pet. You upload photographs of your pet, select a theme, and our Service uses a generative image AI model—an artificial intelligence tool—to produce a unique sticker sheet design. Once you approve your design and complete checkout through our secure payment processing, we print and ship the physical sticker sheets to you through our fulfillment partner.
By using Pipsqueak, you represent and warrant that you are at least 18 years of age or have obtained parental or legal guardian consent. Users under 13 years of age are not permitted to use this Service in accordance with the Children's Online Privacy Protection Act (COPPA). If we become aware that a user under 13 has provided personal information without parental consent, we will take steps to delete such information and terminate the user's account.
Please read this section carefully. Your sticker sheet designs are generated by artificial intelligence, not drawn by a human artist. You should understand the following before placing an order:
Ownership. You retain full ownership of the pet photographs you upload. By uploading photos, you grant Pipsqueak a limited, non-exclusive, revocable license to use your photos for (a) generating your custom sticker sheet designs via our third-party AI provider and (b) internal quality assurance to monitor and improve the quality of our sticker generation service. We do not use your photos for marketing, advertising, or AI model training. Photos retained for quality assurance and service improvement are stored without identifying information.
Your representations. By uploading photos, you represent and warrant that:

Copyright Disclaimer. Under current U.S. Copyright Office guidance and applicable law, AI-generated works that lack sufficient human creative authorship are generally NOT eligible for copyright protection. The sticker sheet designs generated by Pipsqueak may fall into this category and may not be protectable by copyright law. Pipsqueak makes no warranty regarding the copyrightability, non-infringement, or protectable status of any generated design.
Your License. Pipsqueak grants you a personal-use, non-exclusive, non-transferable license to use your generated sticker sheets for personal, non-commercial purposes only. You may display, share, and give away your sticker sheets to family and friends for personal enjoyment.
Prohibited Commercial Uses. Without Pipsqueak's prior written consent, you agree not to:
Pipsqueak's Rights. We do not claim ownership of your generated designs. To the extent Pipsqueak holds any rights in the output, we assign those rights to you. However, Pipsqueak retains the right to use anonymized, aggregated data about design generation patterns for service improvement and research purposes, provided such use does not identify you or reveal personal information.

Sticker sheet pricing is displayed on our website and may change at any time without prior notice. All orders are processed through our secure checkout system. Orders are binding and final once payment is confirmed. Prices are listed in U.S. dollars. Currency conversion for international customers, if applicable, is subject to the exchange rate applied by our payment processor at time of transaction.
Sticker sheets are printed and shipped by our designated fulfillment partner or other vendors as needed. Estimated delivery times provided at checkout are estimates only and are not guaranteed. Pipsqueak is not responsible for delays, damage, or loss caused by shipping carriers, customs delays, weather, vehicle breakdown, or other circumstances beyond our reasonable control.
Risk of loss and title of the sticker sheets transfer to you upon delivery to the shipping carrier. You are responsible for providing accurate shipping information. Incorrect addresses, refused deliveries, or other customer-caused issues may result in reshipment fees or order cancellation at Pipsqueak's discretion.
Due to the custom, personalized, and made-to-order nature of our products, all sales are final and we do not offer refunds or accept returns. Please refer to our Return and Refund Policy for complete details. In summary:
Force Majeure Events. Pipsqueak is not liable for service interruptions or performance failures caused by events beyond our reasonable control, including:
Notification and Remedy. In the event of a force majeure event lasting more than 48 hours that prevents fulfillment of your order, Pipsqueak will make reasonable efforts to notify you via email. You may request cancellation of your order with a full refund if your order has not yet been printed and shipped. If your order has already been shipped, standard return procedures apply.
Our Service depends on third-party services including our AI image generation provider, e-commerce platform, content delivery network, and fulfillment partner. We are not responsible for the availability, performance, accuracy, or actions of these third parties. Service interruptions caused by third-party outages, API limitations, quota exhaustion, or rate limiting may temporarily prevent order placement, design generation, or payment processing.
Pipsqueak maintains usage limits to protect against excessive API costs and service disruption, including global daily generation caps and per-user rate limits. These limits may affect your ability to generate designs during high-traffic periods.

We will make reasonable efforts to provide advance notice of material service changes but are not obligated to do so. Your continued use of the Service constitutes acceptance of any modifications.
You agree to indemnify, defend, and hold harmless Pipsqueak LLC, its founders, officers, employees, agents, and representatives from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to:
Exception. You are not required to indemnify Pipsqueak for claims arising solely and directly from Pipsqueak's gross negligence or willful misconduct. This indemnification obligation does not limit your other rights or remedies.
AS-IS AND AS-AVAILABLE. PIPSQUEAK PROVIDES THE SERVICE "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, REPRESENTATIONS, OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PIPSQUEAK EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY, THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, AND THE IMPLIED WARRANTY OF NON-INFRINGEMENT.
NO WARRANTY OF ACCURACY OR PERFORMANCE. PIPSQUEAK MAKES NO WARRANTY THAT:
LIABILITY CAP. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PIPSQUEAK'S TOTAL LIABILITY TO YOU FOR ANY CLAIM, LOSS, OR CAUSE OF ACTION ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM, OR (B) FIFTY DOLLARS ($50.00).
EXCLUDED DAMAGES. IN NO EVENT SHALL PIPSQUEAK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, COST OF COVER, OR OTHER SIMILAR DAMAGES, EVEN IF PIPSQUEAK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Exceptions to Limitations. These limitations do not apply to liability for personal injury or death, fraud, intentional misconduct, or gross negligence. Some jurisdictions do not permit the exclusion or limitation of implied warranties or certain types of damages. If you are in such a jurisdiction, some of the above limitations may not apply to you, and your statutory rights may provide you with greater protections.
Good-Faith Negotiation. Before initiating litigation or other formal dispute resolution, you and Pipsqueak agree to attempt good-faith resolution of any dispute arising from these Terms or the Service. Either party shall notify the other in writing of the dispute within 30 days of discovering it. Both parties will attempt to resolve the matter through direct negotiation for a period of at least 30 days.
Small Claims Court. Either party may bring individual claims in small claims court that has jurisdiction over the parties' dispute, rather than in arbitration or state/federal court, provided that claims qualify for small claims court jurisdiction. Small claims court claims are not subject to the dispute resolution procedures in this section.
Governing Law. These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any dispute not resolved through good-faith negotiation or small claims court shall be resolved in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction and venue of such courts.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed. The remaining provisions of these Terms shall continue in full force and effect and remain enforceable to the maximum extent permitted by law. Severance of any provision shall not affect the validity or enforceability of any other provision.
These Terms of Service, together with our Privacy Policy and Return and Refund Policy, constitute the entire agreement between you and Pipsqueak regarding your use of the Service and supersede all prior and contemporaneous agreements, understandings, negotiations, and discussions, whether oral or written, between you and Pipsqueak.
No prior oral or written communications, representations, agreements, or course of dealing modify these Terms. If there is any conflict between these Terms and the Privacy Policy or Refund Policy, these Terms control except where the Privacy Policy or Refund Policy explicitly modifies specific provisions herein.
Consent to Electronic Communications. By using Pipsqueak, you consent to receive all communications from us electronically, including these Terms, order confirmations, shipping notifications, receipts, and customer service communications, via email or through your user account on pipsqueak.pet.
Right to Paper Copies. You have the right to request a paper copy of any electronic communication at any time. To request a paper copy, contact us at info@pipsqueak.pet, and we will provide it within 10 business days.
Withdrawal of Consent. You may withdraw your consent to receive electronic communications at any time by contacting us at info@pipsqueak.pet. However, withdrawal of consent may prevent us from processing your order or providing customer service, and you may be unable to use the Service.
Technical Requirements. To receive electronic communications, you must maintain a valid email address and have the ability to access and download PDF documents and text-based emails.

We may update these Terms from time to time to reflect changes in our practices, technology, legal requirements, or other factors. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date at the top of this page. Your continued use of the Service after material changes are posted constitutes your acceptance of the updated Terms.
For material changes, we will provide at least 30 days' notice before the changes become effective. If you do not agree to the updated Terms, you must discontinue your use of the Service.
